It has been a few months since the issuance of the Nigerian Data Protection Regulation (‘NDPR’). The NDPR applies to the processing of the personal information of Nigerians and non-Nigerian residents, and the risks for non-compliance with its provisions are high.
For instance, the NDPR provides that where an organisation (identified as a data controller) dealing with more than 10,000 data subjects is found to be in breach of the privacy rights of its subjects, it will be subjected, in addition to any other criminal liability, to a fine of 2% of annual gross revenue of the preceding year or ten million Naira, whichever is greater.
